Rule 93
Rescue of police personnel

(1) In relation to any official work performed by a police officer in accordance with the Act or this regulation or any other prevailing law, no case can be filed against him without following the procedure as per sub-rule (2).
(2) According to sub-rule (1), in order to prosecute any police officer, the permission of the authority should be obtained in the case of a criminal case, and in the case of a civil case, the following procedure should be followed:-
(a) If the cause of action and the heirs of the plaintiff, the name and address of such heirs, the written notice has been delivered to the authority or the concerned police or registered and sent by post and a copy of the same has been submitted to the center, and
(b) The case has been filed within three months of the cause of action.
(3) No case can be filed against a police officer while he is in office, even after the termination of his office, without the approval of the Center.
(4) According to sub-rule (3), if approval is received from the Center to prosecute the case, the Government of Nepal will defend it.
